Hello,

First of all let me pay my thanks to the admins who started this forum.

I am working in Noida and I am from Nangal Dam, last month I got a new job-offer from a big company but I am working in a small company.

While I resigned from my current company, my employer told that I have to stay with company atleast 3-months. I double checked my offer letter with this company the wrote that If company want then employee can stay 1-3 months or company can expel employee with one month salary. There is a process of buy a notice period when I talked with my seniors they denied the same. HR persons are not agree too

I am in fixed what to do or not to do?

Please guide me anything be possible

Greetings of the day!!!!

Regarding your query, you must be having Offer letter of the present company,if any company offer a job to the employ, they also give the detailed procedure, how to revoke the job. generally it happens that any employee who want to revoke his job, gives one month / two month / three month prior notice to the employer or one month salary. It can vary from company to company.

we would suggest you to follow the procedure as mentioned in your offer letter. no body can force you to work against your own wishes.

Thanks sir,

I know all the above but what should I do when my seniors told if I do not stay with them then they will give -ve feedback to my new employer?

They will not contact your new employer any way. you just
show your new employer that you have followed the whole process as required to change the employer and even then your old employer is threatening you to restrain your document. then i will suggest you to contact your lawyer and serve a legal notice upon them. and follow the
due process of law.

@SBS sir ji, but its a matter of her career but if they will not give her papers then how she can show her experience?

sir,
let me clear the situation. As far as Law is concerned their is no law as such for this sort of situation. but recently Hon'ble SC of India has given a judgment that no body can be forced to do work under compulsion, it is considered as bounded labour. and bounded labour is banned in India.

So the only reamdy left is the Court of Law. Suman can give a complaint to Police Authorities that her documents are her property and and retained by the employer after she had followed the due course of resignation as mentioned in her job offer letter. and the employer is forcing her to do bounded labour against her will by threating her to reuin her carrier

One another remedy is Consumer Court because she is working and service has been given by her.she can approach consumer court also.

I do understand that it is her carrier but the situation which her employer is creating can not be tackled without due assistance of law.
